1. Acceptance of Terms

By accessing and using ioomm (Service), operated by Alvento Ltd (we, us, our), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

ioomm is an AI-powered professional headshot generation service. You upload a selfie, and our system generates professional portrait photographs using artificial intelligence. We offer both free preview and paid packages.

3. User Responsibilities

You agree to:

• Upload only images where you have the right to use and process the image
• Upload only images of yourself or images where you have explicit consent from the person depicted
• Not upload images of minors without parental consent
• Not use the Service for any illegal, harmful, or abusive purposes
• Not attempt to circumvent rate limits or payment systems
• Not use generated images in a way that misrepresents, defames, or harms others

4. Image Usage and Retention

Retention: Unpaid sessions are automatically deleted after 24 hours. Paid sessions are retained for up to 30 days to allow downloads and support, then deleted.

Your Rights: Generated images belong to you. You may use them for personal or commercial purposes. We do not claim any ownership or rights to your generated images.

Our Use: We do not use your uploaded images or generated portraits to train AI models or for any purpose beyond generating your requested portraits.

5. Payments and Refunds

Pricing: Our pricing is displayed in GBP (£). We offer a free preview tier and paid packages (Starter, Pro, and Executive).

Payment Processing: All payments are processed securely through Stripe. We do not store your payment information.

Refunds: Due to the instant delivery nature of our digital service, we do not offer refunds once images have been generated and delivered. If you experience technical issues preventing delivery, please contact us at hello@ioomm.app.

6. Subscriptions and Cooling-off

You have a statutory right to cancel within 14 days of purchase unless you have requested immediate performance of the Service, in which case you waive that right once generation begins. Refunds for technical failures will be provided as required by applicable law.

7. Rate Limits

We currently do not enforce a daily cap on generation sessions. If we detect abuse or platform strain, we may introduce temporary safeguards and will update this policy accordingly.

8. Service Availability

We strive to provide 99% uptime but do not guarantee uninterrupted access. We reserve the right to:

• Temporarily suspend the Service for maintenance
• Modify or discontinue features with reasonable notice
• Refuse service to anyone who violates these terms

9. Intellectual Property

To the extent permitted by applicable law, the ioomm platform, including its design, code, prompts, and algorithms, is owned by Alvento Ltd and protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of our Service.

10. Limitation of Liability

To the maximum extent permitted by law, Alvento Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the past 12 months.

11. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We do not guarantee that generated images will meet your specific requirements or that the Service will be error-free. AI-generated results may vary.

12. Governing Law

We endeavour to provide the Service with reasonable care and skill but do not guarantee uninterrupted or error-free operation. The Service is provided for general use without warranties as to specific results.

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or prominent notice on our website.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
